Titolo originale: “Cannabis libera? Se non ora quando…“
Legalizzare la cannabis. Trent’anni dopo i primi “tentativi” del legislatore, torna d’attualità, con tanto di nuova proposta di legge presentata in Parlamento dal senatore Pd Luigi Manconi. Ma soprattutto la battaglia rompe i tradizionali steccati ed esce dalla marginalizzazione dell’ultimo decennio, quello in cui ha dominato la legge Fini-Giovanardi, con il suo approccio iper-proibizionista che abolendo persino la modica quantità e punendo il consumo ha intasato le carceri e aperto le porte dell’inferno giudiziario a centinaia di migliaia di adolescenti con un paio di «canne» in tasca.
Il dibattito sulla liberalizzazione questa volta si è riacceso in un luogo politico inconsueto: la Lega Nord. È stato ieri, alle due del pomeriggio, quando l’assessore leghista all’Agricoltura della Regione Lombardia Gianni Fava ha scritto in un post: «Credo valga la pena cominciare a parlarne seriamente». Scofessato dal segretario del Carroccio Matteo Salvini, ha ridotto il tiro: «Trattasi di opinione personale che non impegna la Lega», ma il governatore della Lombardia Roberto Maroni, a quel punto, ha sbandato: prima è sembrato appoggiare il suo assessore, ritwittando il post, poi lo ha sconfessato, dando la colpa al suo staff della comunicazione che «aveva capito male». Atteggiamento ondivago che ha indispettito il Nuovo centro destra lombardo.
La ministra della Salute Beatrice Lorenzin – contraria – si è limitata a pubblicare sul sito del ministero i possibili danni da uso e abuso di droghe leggere, ma il dibattito già era partito con un altro piede. Lo stesso segretario del Pd, Matteo Renzi, è stato cauto: «Discussione schizofrenica, andiamo per ordine. Prima aboliamo la Fini-Giovanardi, poi ripristiniamo la differenzazione fra droghe pesanti e leggere». Come a dire: per la legalizzazione c’è tempo.
ll presidente di Sinistra Ecologia e Libertà, governatore della Puglia, Nichi Vendola, aveva già rilanciato: «La Fini-Giovanardi è una legge sbagliata, feroce, inefficace. Il probizionismo non è altro che manna dal cielo per i narcotrafficanti. È ora di legalizzare la cannabis».
Luigi Manconi, presidente della commissione parlamentare per i diritti umani, ha tirato fuori dai suoi cassetti un disegno di legge già pronto in materia di coltivazione e cessione della cannabis e dei suoi derivati. «Dopo trent’anni di fallimenti della politica proibizionista in tutto il mondo – ha esultato – che ha portato solo ampliamento del mercato e del numero di consumatori, carcerizzazione di massa e sofferenze sociali, si è avviata finalmente una riflessione da parte di molti enti pubblici e di alcuni stati nazionali».
Il ddl Manconi, presentato al termine della settimana di audizioni parlamentari, raccoglie le due “ipotesi” previste anche da Renzi, ma va oltre. Pevede la non punibilità della coltivazione per uso personale di marijuana e della cessione di piccoli quantitativi dei derivati della cannabis finalizzata all’immediato consumo personale. Prevede, poi, il ripristino della distinzione tra droghe leggere e pesanti, con una riduzione delle pene per le prime, fino alla cancellazione delle sanzioni amministrative per i consumatori. «In questo modo – spiega il senatore – si potrà ristabilire un solco chiaro tra comportamenti inoffensivi legati al consumo personale di sostanze che non nuocciono gravemente alla salute, non più di quanto faccia l’abuso di tabacco e di alcool, e il traffico di sostanze stupefacenti».
Tutti argomenti che fanno dire a Pina Picierno, membro della nuova segreteria del Pd, che «i tempi sono maturi per la legalizzazione». Per lei si tratta di andare subito a una depenalizzazione, superare la Fini-Giovanardi, e avviare in Parlamento la discussione sulla legalizzazione. Prospettiva che lascia «sconcertato» solo il vice capogruppo di Forza Italia a Palazzo Madama, Maurizio Gasparri.
A cambiare il clima generale sull’argomento è anche ciò che succede nel mondo. L’Uruguay di José Mujica è stato solo il primo Paese a legalizzare il commercio di canapa indiana (nella foto, ndr). Negli Usa sono ormai sei gli Stati dove l’uso terapeutico è consentito, altri sei dove il possesso è de-criminalizzato e due, dal 2014, quelli dove è legale anche l’uso a fini ricreativi: il Colorado e lo Stato di Washington.
